COMMITMENT TO PRIVACY

The GenEM Foundation (“GenEM”) is committed to protecting the privacy of our funders, grantees, beneficiaries and all other counterparties. New technologies have changed the way information is gathered and used, but our continuing commitment to preserving the security and confidentiality of personal information has remained one of our fundamental responsibilities. The purpose of this Privacy Notice is to inform our counterparties of the details of our privacy practices.

GenEM is the working name of the Genesis Charitable Trust, a charitable trust registered by the Charity Commission for England and Wales with its address at 16 St James’s Street, London SW1A 1ER. GenEM’s charity number is 1148643.

General Data Protection Regulations (UK GDPR) Definition – ‘Personal Data’

Under the UK GDPR ‘personal data’ (referred to as personal information in this notice) means any information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

Collection, Retention and Disclosure of Personal Information

We collect personal information from you when you contact us, enter into a funding, grant or other contractual agreement, enter into a discussion about a topic of common interest, or apply for work with us.  The types and categories of information we collect and maintain will be provided by you and might include name, address, email address, phone number, current and historic job title and place of work.  If you apply for work we will also collect personal information about your previous experience, education, and referees.  You may ask us to disclose the personal information we store about you. 

We may use your personal information to:

  • Fulfil our contractual and other legal obligations;
  • Assess your suitability as a partner, funder, or grantee;
  • Contact you about matters of likely mutual interest;
  • Send you information you may have requested;
  • Assess your suitability for appointment as an employee, contractor or supplier.

The lawful basis of our processing is that it is a) necessary to fulfil our contractual or other legal obligations to you, b) necessary to further our legitimate interests which outweigh any privacy impact that is neither intrusive nor unexpected; or c) consented by you on an explicit and informed basis. 

We will retain your data for no longer than is reasonably necessary for the relevant legal obligation or activity.  Subject to any legal obligations we have you may ask us to delete any personal data we store about you.  In such instances, please email requests to info@genemf.org

We disclose your personal information to non‐affiliated third parties only in limited instances and then only in connection with conducting our business operations.   Some of the instances are listed below:

  • Disclosures to companies that perform services on our behalf (such as our legal counsel,  and our external auditors) subject to agreements that prohibit such companies from disclosing or using the information other than for the services required or as permitted by law;
  • Disclosures at your direction to your professional advisers (such as your accountant, attorney if applicable);
  • Disclosures of information about grantees to current and potential funders;
  • Disclosures required by law, for example for anti-money laundering purposes.

We may transfer data to the USA and other jurisdictions outside the European Economic Area (EEA). Such countries may not have the same data protection laws. Any transmission of personal information by GenEM Foundation or its delegates outside the EEA shall be in accordance with the conditions in the UK GDPR.

Where we require your personal information to comply with Anti-Money Laundering (AML) or other regulatory or legal requirements, failure to provide this information means that we may not be able to accept you as a funder.

Security Of Your Information

We are committed to taking all reasonable and appropriate steps to protect misuse, loss or unauthorised access to your personal data.  These include:

  • Physical, electronic and other procedural safeguards designed to keep your personal information confidential and secure;
  • Limitation of access to personal information to those employees who need it to perform their job duties and are trained in the proper handling of such personal information; and
  • Requiring third parties that perform services for us to keep information confidential and secure.

Your Rights

We respect your right to access and control your information. We will respond to requests for information and, where applicable, will correct, amend, or delete your personal information unless legal or regulatory restrictions (for example for anti-money laundering purposes) prevent us.

Under the UK GDPR your rights include:

  • The right to be informed;
  • The right of access;
  • The right to rectification;
  • The right of erasure;
  • The right to restrict processing;
  • The right to data portability;
  • The right to object; and
  • Rights related to automated decision making.

You have the right to lodge a complaint with the Office of the Information Commissioner’s Office (our supervisory authority for data protection in the UK) if you consider that the processing of personal information relating to you carried out by us or our service providers infringes the UK GDPR.
